The Eleventh Circuit Court of Appeals recently affirmed a $4.3 million judgment that LKSLG Attorneys Jason Kellogg and Matthew McGuane secured in 2017 on behalf of client Leader Global Solutions, LLC. 

Leader Global successfully enforced a personal guaranty against Samuel Yankelewitz, a prominent Costa Rican businessman, in the U.S. District Court for the Southern District of Florida.  Yankelewitz appealed, arguing that a pre-bankruptcy proceeding in Costa Rica barred enforcement.  On February 14, 2019, a panel of Eleventh Circuit judges Jill Pryor, Elizabeth Branch and Julie Carnes issued an 11-page opinion holding that the guaranty remained in force under Florida law. 

“The case really underscores the importance of well-written legal documents for international trade,” Kellogg and McGuane told Law360 in 2017.  “Leader Global’s guaranty brought the fight to the U.S. and helped insulate the company from almost any contingency.”
